CBD Legality by State

Reviewed November 3, 2026 · Cannagea CBD Education

Is CBD legal to possess?

Qualifying hemp-derived CBD can be legally possessed in many states, but there is no unconditional yes for every product in all 50 states. CBD legality by state depends on the actual THC content, ingredients, product form, age and state hemp definition. Use the map and state summaries to compare possession laws for CBD oil, capsules, gummies, topicals and smokable hemp across all 50 states and Washington, D.C.

CBD product types: oils, gummies, topicals and smokables

Broad Spectrum / THC Free consumables: oils, capsules and gummies with lab-confirmed nondetectable THC. A broad-spectrum label alone does not prove a product is THC-free.

Full Spectrum consumables: oils, capsules and gummies containing THC. Check the state’s total-THC, serving, container and cannabinoid-ratio rules where applicable; “under 0.3%” is not a universal answer.

Topicals: cosmetic creams, lotions, balms and salves for external use, including THC-free and full-spectrum formulas. This category does not cover transdermal drugs.

Smokables: hemp flower, pre-rolls and inhaled CBD vapes. A state can treat raw flower and a finished vape differently; read the state note.

How to read the possession chart

Allowed* = qualifying hemp only. Limited* = additional formula, form or category limits. Restricted* = a possession or licensing restriction affects this category; read the note. Verify = the cited guidance does not settle the exact product. *Open your state before relying on an answer.

Personal possession by adults 21+ of nonintoxicating hemp CBD. This is a comparison baseline, not a statement that every state sets the minimum age at 21. State THC definitions and other conditions still apply. The chart concerns holding a product for personal use. It does not determine whether smoking, vaping, public consumption, driving, growing or resale is allowed. Local, tribal and federal-property rules can differ.

Federal law excludes qualifying hemp from the marijuana definition. State definitions can be stricter, and a product outside a hemp exemption may require a separate cannabis-law analysis. A rule governing sales is not automatically a personal-possession prohibition. Official source: 21 U.S.C. §802.

CBD possession laws by state

These summaries explain the conditions behind the chart. Sources are official statutes, regulations and agency guidance. “Verify” identifies an unresolved product-specific question rather than treating uncertainty as permission or a ban.

Is CBD legal to possess in Alabama?

Adults 21+ may possess qualifying finished hemp CBD. Alabama expressly prohibits possession of products excluded from its consumable-hemp definition. Smokable hemp is excluded, including flower, buds, joints and other cannabinoid smoking products; the statute applies even to nonpsychoactive cannabinoids. The smokables restriction is therefore a possession rule, not merely a sales restriction. Other products must satisfy the lawful hemp category.

Official sources: Alabama Act 2025-385: §§28-12-2, 28-12-49 and 28-12-61.

Is CBD legal to possess in Alaska?

Qualifying industrial hemp is excluded from marijuana under Alaska’s controlled-substance definitions. The actual final product must qualify. A full-spectrum label does not establish that exception, and products outside it require a separate cannabis-possession analysis.

Official sources: Alaska DNR: industrial hemp and endorsements · Alaska Statutes 11.71: controlled-substance definitions.

Is CBD legal to possess in Arizona?

Qualifying hemp CBD is distinct from marijuana. This supports possession of compliant THC-free and full-spectrum products, including finished consumables, but does not cover excess THC or other controlled cannabinoids. Check the final product’s composition.

Official sources: Arizona Agriculture: industrial hemp FAQ · ADHS: food and dietary-supplement ingredients · Arizona AG: hemp and controlled-cannabinoid distinctions.

Is CBD legal to possess in Arkansas?

Qualifying consumable hemp is excluded from marijuana, and the law expressly includes inhalation within consumption. CBD-focused oral and inhaled products can qualify only within the narrow exemption: no more than 1 mg total THC per container, a CBD:THC ratio greater than 15:1, and the specified composition requirements. Cosmetics have a separate exemption. Flower, pre-rolls and vapes are not automatically exempt just because they contain less than 0.3% THC.

Official sources: Arkansas Act 934: marijuana exclusion and §§20-56-502–503 · Arkansas Attorney General: Act 934 certification.

Is CBD legal to possess in California?

Qualifying hemp CBD is distinct from cannabis. If a full-spectrum or inhaled product instead falls under cannabis law, adults 21+ have a separate possession allowance: up to 28.5 grams of nonconcentrated cannabis and 8 grams of concentrated cannabis, including concentrate within products. The concentrate limit is not the gross weight of a bottle or gummy. AB 8 retail restrictions do not, by themselves, eliminate these adult possession allowances.

Official sources: California Health: adult possession limits · California POST: controlled substances workbook, HSC §11362.1 · CDPH: AB 8 product-specific FAQ.

Is CBD legal to possess in Colorado?

CBD products meeting Colorado’s hemp definition are distinct from marijuana. The final THC content and cannabinoid composition matter for full-spectrum products. A product outside the hemp definition may fall under the separate adult cannabis framework and its possession limits.

Official sources: Connecticut DCP: CBD permits and licenses · Connecticut §§21a-240 and 21a-279a.

Official sources: Delaware Code: Title 4, §1313A and infused-beverage definitions · Delaware §4701: marijuana and hemp definitions.

Is CBD legal to possess in Florida?

Florida expressly states that hemp is not a controlled substance. Qualifying hemp CBD can therefore be possessed, subject to the actual formula meeting the state definition. Excess THC or another controlled ingredient can change the answer, even in a product labeled CBD.

Official sources: FDACS: hemp for human consumption FAQ · Florida §581.217: hemp is not a controlled substance.

Is CBD legal to possess in Georgia?

Adults 21+ may possess qualifying finished hemp CBD, including compliant finished vape products. Unlicensed handling of raw hemp plants is restricted, while the handling definition exempts finished hemp products. Flower and pre-rolls must not be treated as interchangeable with finished extracts. The smokables rating reflects the raw-hemp licensing restriction. Georgia separately prohibits under-21 possession of consumable hemp.

Official sources: Georgia SB 494, enacted: handling definition, licensing and possession · Georgia HB 213, enacted: marijuana and THC hemp exclusions · Georgia Agriculture: current consumable-hemp guidance.

Is CBD legal to possess in Hawaii?

Hawaii excludes qualifying finished hemp products from marijuana and marijuana concentrate when they contain no living plants, viable seeds, leaf or floral material and no more than 0.3% delta-9 THC measured after decarboxylation. Raw hemp flower lacks this ordinary consumer exemption; producer and processor exceptions require authorization. A finished vape extract and a flower pre-roll therefore have different possession treatment. The separate retail inhalables prohibition does not itself establish a blanket vape-possession offense.

Official sources: Hawaii HRS §712-1240: hemp possession and product exclusions · Hawaii Health: manufactured-hemp consumer FAQ.

Is CBD legal to possess in Idaho?

Qualifying processed CBD products must contain no THC and meet Idaho’s lawful-source requirements. Full-spectrum products containing THC do not qualify merely because they are below 0.3%. Topicals must also satisfy the zero-THC rule. Raw hemp flower has separate licensing restrictions; verify inhalable extracts.

Official sources: Idaho Agriculture: hemp FAQ · Idaho Drug Policy: CBD.

Is CBD legal to possess in Illinois?

Illinois excludes qualifying industrial hemp from cannabis. Possession of compliant hemp CBD is distinct from cannabis possession on the review date. Products outside that definition require a separate adult-use cannabis analysis; a future change is not applied before its effective date.

Official sources: Illinois Governor: SB 3222 and effective dates · Illinois Agriculture: hemp program · Illinois Cannabis Control Act §3.

Official sources: Iowa HHS: consumable hemp rules · Iowa Code chapter 204 · Iowa §204.14A: inhalable-hemp possession offense · Iowa §204.7: consumable hemp exemption.

Is CBD legal to possess in Kansas?

Official sources: Kansas Statutes §2-3908: prohibited products · Kansas §21-5701: hemp and cannabidiol exclusions.

Is CBD legal to possess in Kentucky?

Qualifying hemp extracts are distinct from marijuana, but Kentucky restricts unlicensed handling of hemp leaf and floral material. Extracts over 0.3% THC are also prohibited outside an authorized framework. Flower and pre-rolls need licensing review; verify vape formulations individually.

Official sources: Kentucky CHFS: hemp-derived cannabinoid products · Kentucky regulation 902 KAR 45:021 · Kentucky KRS 260.858.

Is CBD legal to possess in Louisiana?

Adults may possess qualifying hemp products through the lawful hemp framework. Smokables remain unresolved: R.S. 40:961 excludes lawfully cultivated and processed industrial hemp from marijuana, while the amended §961.1 ties a separate controlled-substance exemption to licensed or permitted channels. Inhalables and retail flower cannot enter the approved consumable-hemp channel. The reviewed official sources do not clearly reconcile these provisions for an adult simply possessing compliant CBD flower or a vape; a retail ban alone is insufficient.

Official sources: Louisiana R.S. 40:961: marijuana and industrial-hemp definitions · Louisiana R.S. 40:961.1: exemption amended in 2025 · Louisiana R.S. 3:1482: inhalables and retail-flower prohibitions.

Maine excludes qualifying hemp from marijuana. Compliant THC-free and full-spectrum hemp products therefore have a different possession status from marijuana. The actual product must meet the hemp definition; a CBD label or a low advertised THC percentage alone is insufficient.

Official sources: Maine Agriculture: CBD retail guidance · Maine statute 22 §2158-A · Maine §1101: marijuana excludes hemp.

Is CBD legal to possess in Maryland?

Michigan excludes industrial hemp from marijuana, but the definition considers the final product’s THC concentration and applicable total-THC limit. Possession depends on the actual composition. Full-spectrum products require particular attention to the batch’s THC and precursor results.

Official sources: Michigan MDARD: hemp in food and dairy · Michigan Courts: current hemp and marijuana definitions.

Is CBD legal to possess in Minnesota?

Adults 21+ may possess qualifying hemp-derived consumer products and lower-potency hemp edibles. Verify other topical and oral formulations individually.

Official sources: Minnesota OCM: conversion guide and product categories · Minnesota OCM: LPHE consumer guide · Minnesota §342.09: personal adult use.

Official sources: Mississippi Medical Cannabis Program: CBD oversight · Mississippi Pharmacy Board: controlled-substance law.

Is CBD legal to possess in Missouri?

Missouri excludes industrial hemp, including qualifying hemp commodities and products, from marijuana. Compliant hemp CBD possession depends on meeting that definition. Products outside the exception follow separate cannabis rules; full-spectrum branding alone does not establish qualification.

Official sources: Missouri DCR: general FAQ · Missouri statute §195.900 · Missouri §195.010: hemp exclusion.

Official sources: Montana DPHHS: CBD and hemp food guidance · Montana DPHHS: hemp and marijuana distinctions.

Is CBD legal to possess in New Mexico?

Qualifying hemp CBD may be possessed in all four categories. New Mexico excludes hemp from the Cannabis Regulation Act’s cannabis definition and provides a hemp exception in §30-31-6(E). Its finished-hemp framework recognizes oral products, cosmetics and inhaled products. The actual product must qualify, including applicable THC and ingredient limits. Manufacturing or retail requirements are not automatically separate criminal possession limits, and this rating does not cover synthetic intoxicating cannabinoids.

Official sources: New Mexico enacted HB 2: hemp exclusion and §30-31-6(E) · New Mexico Environment: 2026 final hemp-rule explanation.

Official sources: New York OCM: permitted and prohibited forms · New York Cannabis Law §3.

Is CBD legal to possess in North Carolina?

North Carolina expressly excludes hemp and hemp products from marijuana. Personal possession of a product genuinely meeting those definitions is therefore distinct from marijuana possession. Check THC and other ingredients; the word CBD on a label does not establish the exemption.

Official sources: North Carolina Agriculture: hemp and processor FAQ · North Carolina: Food and Drug Protection · North Carolina §90-87.

Is CBD legal to possess in North Dakota?

Qualifying hemp and allowed hemp products have controlled-substance exceptions. The hemp-product definition excludes hemp-derived compounds used to make inhalants; §4.1-18.1-04.4 sends nonallowed cannabis or hemp products to the medical-marijuana framework. A CBD vape therefore does not receive ordinary consumer clearance merely for being below 0.3% THC. Qualifying raw hemp flower has a separate hemp definition. The red smokables rating reflects the inhalant restriction, not a blanket ban on every hemp plant part.

Official sources: North Dakota chapter 4.1-18.1: product definitions and medical pathway · North Dakota chapter 19-03.1: marijuana and THC exclusions · North Dakota Agriculture: hemp and prohibited products.

Is CBD legal to possess in Ohio?

Ohio expressly permits unlicensed possession of qualifying hemp and hemp products. Since March 20, 2026, the definition uses total THC, including THCA, and excludes finished cannabinoid products exceeding 0.4 mg per container of covered THC-like compounds. The finished-product definition includes inhalation, so flower, pre-rolls and vapes offered as consumer cannabinoid products need that analysis too. Passing a 0.3% concentration test alone does not establish the exemption.

Official sources: Ohio §928.02(C): express possession permission · Ohio §928.01: definitions effective March 20, 2026.

Is CBD legal to possess in Oklahoma?

Is CBD legal to possess in Pennsylvania?

A definitive statewide consumer-possession answer remains unresolved. Pennsylvania State Police guidance treats hemp consumables containing any THC as illegal, creating a specific concern for full-spectrum products. A November 2026 Berks County notice describes a 0.3% threshold for plant material; that does not settle finished extracts. The sources reviewed do not establish an unambiguous possession exemption covering every THC-free extract, topical or inhaled form either. These cells need Pennsylvania legal review, not an assumption that CBD is universally legal or banned.

Official sources: Pennsylvania State Police: THC guidance, March 2025, page 6 · Berks County District Attorney: November 2, 2026 enforcement notice · Pennsylvania Revenue: CBD legality caveat.

Is CBD legal to possess in South Dakota?

Qualifying hemp is excluded from marijuana. Raw hemp obtained for storage or processing requires licensing under §38-35-2; finished manufactured hemp products have an exception. The smokables rating reflects this raw-material restriction, not a blanket offense for merely possessing every finished CBD vape. Separately, §38-35-21 prohibits smoking or inhaling hemp even where possession is lawful. Controlled synthetic cannabinoids and THC resins need separate analysis and are not cleared by a CBD label.

Official sources: South Dakota §22-42-1: hemp exclusion · South Dakota chapter 38-35: current licensing and inhalation rules · South Dakota Attorney General: cannabinoid distinctions.

Is CBD legal to possess in Tennessee?

Official sources: Tennessee TABC: current hemp FAQ · TABC: supplier product forms · Tennessee TABC: legal product classification.

Is CBD legal to possess in Texas?

Texas distinguishes lawful hemp CBD from controlled cannabis. Possession depends on current hemp and cannabinoid requirements. Excess THC and other controlled ingredients change the analysis; a restriction on manufacturing smoking products does not itself establish a consumer-possession ban.

Official sources: Texas DSHS: consumable-hemp FAQ · Texas DSHS: current program notices · Texas State Law Library: consumable hemp · Texas State Law Library: CBD legality.

Is CBD legal to possess in Utah?

Utah’s lawful finished-CBD pathway depends on cannabinoid composition and the authorized product category. Handling hemp leaf or floral material requires the appropriate license under §4-41-105, so flower and pre-rolls do not have blanket ordinary-consumer permission. The red smokables rating reflects that raw-material restriction. Smokable-flower use is also prohibited. Finished inhaled extracts need separate classification; the general CBD pathway must not be read as permission for every vape.

Official sources: Utah §4-41-105: current raw-material licensing restriction · Utah Agriculture: current industrial-hemp FAQ · Utah §4-41-402: cannabinoid use and exceptions.

Is CBD legal to possess in Vermont?

Vermont excludes hemp and qualifying hemp products from cannabis. Personal possession depends on that classification and the applicable composition rules. A product classified as cannabis has separate adult-use possession limits; a CBD label or low percentage alone cannot settle the question.

Official sources: Vermont CCB: hemp definitions and limits · Vermont CCB: compliance FAQ · Vermont §4201: hemp exclusions.

Is CBD legal to possess in Virginia?

Virginia excludes qualifying lawfully sourced hemp products from marijuana. Check the actual hemp definition and final composition. The retail 2 mg package cap is not automatically a criminal personal-possession threshold; products classified as cannabis follow separate adult-possession rules.

Official sources: Virginia CCA: current hemp information · Virginia Agriculture: hemp-product oversight · Virginia §18.2-247: hemp-product exclusion.

Is CBD legal to possess in Washington?

Washington’s current controlled-substance definition excludes hemp from cannabis. Qualifying hemp CBD has a distinct possession status. Official sources: Wisconsin DATCP: hemp flower and CBD labeling · Wisconsin DATCP: hemp program · Wisconsin Courts: statutory hemp exclusion discussion.

Is CBD legal to possess in Wyoming?

Wyoming expressly permits possession and use of qualifying hemp, subject to statutory exceptions. Permission depends on the actual total-THC and composition rules, including the treatment of precursors and synthetic substances. It does not extend to every product marketed as CBD.

Official sources: Wyoming: enacted hemp amendments, 2024 chapter 56 · Wyoming §35-7-1063.

Is CBD legal to possess in Washington, D.C.?

D.C. allows limited adult cannabis possession under local law, with separate rules for product forms, quantities and medical-program authority. Do not apply a flower quantity allowance automatically to an oil or gummy. These local permissions do not apply on federal land.

CBD legality FAQ: possession and product types

Is CBD legal to possess in all 50 states?

Not every CBD product is legal everywhere. Many states exempt qualifying hemp, but THC content, form and age can change the answer. Idaho’s zero-THC requirement and Iowa’s prohibition on possessing inhalable hemp are examples. Check the state note for the exact category.

Is broad-spectrum CBD the same as THC-free CBD?

Not necessarily. Broad spectrum describes an extract profile, not a legal test result. This guide’s THC-free column assumes a batch report showing nondetectable THC. Detection limits and the state’s legal standard still matter.

Is full-spectrum CBD legal to possess?

Yes, when the exact product meets the applicable hemp definition or another lawful possession category. Trace THC can still exceed a state’s limit. Idaho does not accept THC-containing products through its ordinary processed-CBD pathway.

Are CBD oil, gummies and capsules legal to possess?

They can be, when the exact product qualifies under your state’s hemp or other lawful possession framework. Choose the THC-free or full-spectrum consumables column, then check your state’s note. Oils, capsules and gummies are grouped for comparison, but a state may treat their formulas differently.

Are CBD creams, lotions and salves legal to possess?

Qualifying hemp CBD topicals can be lawfully possessed in many states. The topical column covers external cosmetic creams, lotions, balms and salves, including THC-free and full-spectrum formulas. Check the state’s THC and product-category conditions; this category does not cover transdermal drugs.

Is CBD flower legal to possess?

There is no single nationwide answer. Some states distinguish raw hemp flower and pre-rolls from finished CBD extracts or vapes. Select Smokables and read the state note: a restriction may apply to one form within that category. A product below 0.3% THC is not automatically exempt from every state’s possession or licensing rules.

Does legal possession mean I can smoke or vape CBD?

No. Possession and use are separate questions. South Dakota prohibits inhalation use, and Iowa expressly prohibits possession of hemp intended for inhalation. Other states distinguish raw flower from finished extracts.
